General Terms and Conditions of Sale
Version 2023-01, published and effective as of December 13, 2023
These General Terms and Conditions of Sale apply to all orders placed and contracts concluded regarding Salomon products ("Products") via our online shop website(s) at www.salomon.com/de-de (the "Online Shop") between us—
Amer Sports Deutschland GmbH, a German company registered in the Commercial Register of the Local Court of Munich under No. HRB 77902, with its registered office at Parkring 15-17, 85748 Garching, Germany ("Salomon," hereinafter also referred to as "we" or "us")—and you as our customer ("Customer" or "You").
1. About These Terms and Conditions of Sale; Scope of Application
These Terms and Conditions of Sale apply exclusively to purchases made via the Online Shop. Consequently, all orders placed via the Online Shop, as well as any deliveries resulting from such orders, are subject to these Terms and Conditions of Sale. The contractual language is German.
We may amend or supplement these Terms and Conditions of Sale. The amended Terms and Conditions of Sale shall apply only to orders placed after the time of such amendment and which are displayed to you during the ordering process.
When placing an order, you will be asked to expressly accept these Terms and Conditions of Sale. An order for Products cannot be processed without your acceptance of these Terms and Conditions of Sale.
2. Eligibility to Order
Please note that orders may be placed only by non-commercial individuals—i.e., consumers within the meaning of Section 13 of the German Civil Code (BGB). For the purposes of these Terms and Conditions of Sale, a non-commercial individual is any natural person who concludes a contract for a purpose that cannot be attributed predominantly to either their commercial or their independent professional activity. We will therefore not accept orders from companies, business entities, self-employed individuals, or any other type of legal entity.
To purchase products from us, you must:
Provide your name, address, telephone number, email address, payment details, and any other required information;
Be at least 18 years of age;
Have full legal capacity; and
Have a delivery address within Germany.
Any changes to the aforementioned information—particularly changes to your address or email address—must be communicated to us immediately to ensure the smooth processing of your order.
If you order ski bindings, in addition to the above requirements, we require the following information in order to mount the bindings onto the skis:
Age
Skiing proficiency level
Height (in centimeters)
Weight (in kilograms)
Sole length of the ski boots to be used with the bindings (in millimeters)
Desired mounting position for the ski bindings
Please note that we do not perform the final adjustment of your ski bindings. Please consult a ski industry specialist to have the bindings adjusted and fitted to your ski boots, and to have them tested using appropriate equipment prior to any use. Any use of your ski bindings or skis prior to such adjustment is prohibited.
If you have created an account with a personal user ID and password, please keep your password secure at all times and do not share it with third parties. In the event of misuse, you are personally liable for any purchases made using your user ID and password. This liability applies only if you are at fault for the unauthorized use of your user account.
3. Order Process and Formation of Contract
The presentation of our products in the webshop does not constitute a binding offer on our part, but rather an invitation for the customer to submit an offer. By placing an order, the customer submits a binding offer to conclude a purchase agreement for the products specified in the order—at the purchase price specified therein—subject to these Terms of Sale. Subsequently, the customer receives an automatic order confirmation acknowledging our receipt of their offer. This automatically generated confirmation simultaneously constitutes—subject to the availability of the products ordered by the customer—our acceptance of their offer. Accordingly, acceptance of the offer typically takes place immediately after the order has been placed. In this instance, the customer receives an order confirmation specifying the order number and listing the products ordered. No purchase contract is concluded with respect to products from the same order that are not listed in the order confirmation.
We reserve the right to decline orders—particularly abusive or unusual orders, orders that we believe were not placed in good faith, and orders not placed by private individuals. We are under no obligation to provide a reason for declining to accept an offer, although we may do so in
